Article 2 — Scope
These general terms and conditions apply, without restriction or reservation, to all distance sales concluded between Léer Jewels and any consumer customer, within the meaning of the French Consumer Code, on the shop's website. They prevail over any other terms. Placing an order implies full and unreserved acceptance of these terms, which the customer acknowledges having read before confirming. Léer Jewels may amend them; the terms applicable are those in force on the date of the order.
Article 3 — Products
The products offered are stainless steel jewelry, presented with their main characteristics on each product page. Photographs are as faithful as possible but are not contractually binding, as colors may vary depending on screens. Offers are valid while they are visible on the website and subject to available stock. If a product becomes unavailable after an order is placed, the customer is informed without delay and refunded the amounts paid no later than fourteen days after payment.
Article 4 — Ordering
The customer selects the desired items, checks the contents of the basket, enters their details, then confirms the order after reviewing the summary. This confirmation, followed by payment, constitutes conclusion of the contract and irrevocable acceptance of the order. A confirmation email summarizing the order is sent to the customer. Léer Jewels reserves the right to refuse or cancel any order that appears abnormal or fraudulent, or that comes from a customer with whom a payment dispute remains unresolved.
Article 5 — Prices
Prices are shown in euros, including all taxes, excluding shipping costs. Shipping costs are shown to the customer before payment is confirmed and are charged in addition depending on the destination, except where shipping is free under the conditions described in our shipping policy. Léer Jewels reserves the right to change its prices at any time. Products are invoiced at the price in force when the order is recorded.
Article 6 — Payment
The price is due in full upon ordering. Payment is made using the methods offered at checkout, through Shopify's secure payment platform. Banking data is transmitted in encrypted form and is not retained by the seller. The order is processed only once the price has actually been received. If the bank refuses authorization, the order is automatically cancelled.
Article 7 — Delivery
Products are delivered to the address given by the customer when ordering, in the geographical areas served and according to the delays and conditions detailed in our shipping policy. The customer is responsible for the accuracy of the information they provide. Unless another date is indicated, delivery takes place no later than thirty days after the contract is concluded, in accordance with article L. 216-1 of the French Consumer Code. In the event of delay, the customer may call on the seller to deliver within a reasonable additional period and, failing that, terminate the contract under articles L. 216-2 to L. 216-6. The risk of loss or damage passes to the customer upon physical delivery of the goods. We recommend checking the condition of the parcel on receipt and raising any reservations with the carrier.
Article 8 — Right of withdrawal, returns and exchanges
The consumer customer has fourteen calendar days from receipt to exercise their right of withdrawal, without giving a reason or paying a penalty. The procedure, return shipping costs, refund times, exchanges and legal exceptions are detailed in our return and refund policy, which forms an integral part of these terms.
Article 9 — Legal guarantees
All products benefit from the legal guarantee of conformity provided for in articles L. 217-3 et seq. of the French Consumer Code, as well as the guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code. The consumer has two years from delivery of the goods to act under the guarantee of conformity. They may choose between repair and replacement, subject to the cost conditions provided by law, and are exempt from proving that the defect existed during this period. The legal guarantee applies independently of any commercial guarantee.
Article 10 — Product care
Stainless steel keeps its shine provided it is properly cared for. We recommend removing jewelry before showering, swimming and exercising, avoiding contact with perfumes and chemicals, and storing it in a dry place. Damage resulting from abnormal use or lack of care is not covered by the guarantees.
Article 11 — Force majeure
Léer Jewels' liability cannot be engaged in the event of non-performance caused by force majeure within the meaning of article 1218 of the French Civil Code. Obligations are suspended for the duration of the event; if it continues beyond thirty days, either party may terminate the contract without compensation.
Article 12 — Personal data
The data collected is necessary to process the order and is handled in accordance with our privacy policy.
Article 13 — Complaints and mediation
Any complaint may be sent to contact@leerjewels.com or by post to the registered office. We undertake to reply as soon as possible. In accordance with article L. 612-1 of the French Consumer Code, the consumer may use a consumer mediator free of charge to seek an amicable resolution of a dispute with the professional, after first trying to resolve the matter directly with the professional through a written complaint.
Competent mediator: Centre de la Médiation de la Consommation de Conciliateurs de Justice (CM2C), 49 rue de Ponthieu, 75008 Paris, France — website: www.cm2c.net — phone: +33 1 89 47 00 14.
Article 14 — Governing law and jurisdiction
These terms are governed by French law. Failing an amicable resolution, the dispute will be brought before the competent courts under ordinary law. These terms do not affect the mandatory rights that the consumer enjoys under the law of their habitual residence within the European Union.
Article 15 — Partial invalidity
If any provision of these terms is declared void or unenforceable, the remaining provisions will remain fully in force and effect.
